General Conditions and Terms of Service:
The website in desktop and mobile versions and the homeappp.com applications (hereinafter: "Site and App") are owned by the company ZMQ S.R.L. Piazza Bologna 1 Roma VAT number 16879251003 (hereinafter: "Owner").
Access to the Site and App and all services entails from the user (hereinafter "User") the respect and acceptance of all these General Terms of Use (hereinafter: "Terms"). For this reason, it is suggested to read this document very carefully if you wish to access and use the services offered by the Site. This document sets forth the terms and conditions for the use of the services offered on the site by the User.
1. Object of the Contract: The "Site and App" provide a service that helps people search for and sell real estate. Users can enter their requests and personal data through a wizard format form. The data entry and search service is free and does not entail any obligation or commitment for either party. The User has the right to request the deletion of personal data at any time.
2. Compensation: The User understands and agrees that the service of entering data in the App is free and does not entail any obligation or expense. The User will be required to pay a brokerage fee only in the event that they decide to purchase a property that matches the characteristics they entered in the wizard, and/or in the event that they are seeking a buyer for their own property described in the wizard and are actually assisted in the sale. The compensation and the relationship will be separately established in a brokerage contract with the real estate agency partner or partners of the Owner who will manage the brokerage. In no case will any compensation be due to the Owner for the services provided on the site and by the real estate agency partner or partners.
3. Limitation of Liability: The User understands and agrees that the App only provides a search service and that the Owner does not guarantee the availability of properties corresponding to the characteristics entered by the User. The Owner declines any responsibility for any damages resulting from the use of the Site and App. The Owner reserves the right to prohibit access to the Site and App, both permanently and temporarily, at its sole discretion. Users subject to such exclusionary measures may not subsequently attempt to access the Site and App under a different name or through other accounts. The User shall be liable for any direct or indirect damages that the Owner or its affiliated companies may suffer due to a breach of the Terms of Use regarding the use of the Site and App. Furthermore, the User undertakes to indemnify the Owner from any penalties, claims, or legal actions by third parties, including public authorities, against the Owner, its employees, or collaborators, following a violation of third-party rights by the User in the use of the Site and App or related services, in violation of the provisions of these Terms.
4. Changes to the Contract: The Owner reserves the right to make changes to this Contract at any time. Changes will be made public by modifying this document. The User is required to accept the changes to continue using the Site and App and the services offered therein.
5. Cancellation Terms: The User may stop using the App at any time. In case of a request for cancellation of personal data, the User must contact the Owner through the contact form on the Site and App.
6. Dispute Resolution: In the event of disputes arising from this Contract, the parties agree to the exclusive jurisdiction of the court of Rome.
Privacy and Personal Data Protection: The processing of Users' personal data is carried out in accordance with the applicable regulations. For additional details, please refer to the Privacy and Personal Data Protection Policy.
Security: The Owner has implemented adequate security measures to ensure the confidentiality and integrity of personal data, in accordance with applicable laws. For further details, please refer to the Privacy and Personal Data Protection Policy.
Cookies: Some pages of the Site and App use non-intrusive or harmful cookies, which do not contain personal data. The main function of cookies is to personalize the browsing experience. By accepting this Contract, the User confirms that they have read, understood, and accepted all the terms and conditions contained herein.
